Property Rights Element (TTA2022004)

Jurisdiction: City of Tallahassee & Leon County

Text Amendment: The State Legislature passed and the Governor signed HB 59 during the 2021 legislative session. The bill includes a new requirement that local governments adopt a Property Rights Element into their comprehensive plans. This new Element would reaffirm the rights of property owners established by the US Constitution, the Florida Constitution, State Statutes (including the Bert Harris Act), and local ordinances. The bill requires that the new Property Rights Element be adopted prior to any proposed plan amendments.

Text Amendment: This is a text amendment request to amend the Future Right-Of-Way Needs Map found in the Mobility Element of the Comprehensive Plan. The proposed amendment would update the Future Right-Of-Way Needs Map (Map 27) to reflect right-of-way that is needed to implement Blueprint 2020 projects and projects identified in the Capital Region Transportation Planning Agency’s (CRTPA’s) 2045 Regional Mobility Plan Cost Feasible Plan. The proposed amendment would also remove projects from the map that are completed or have the right-of-way needed to complete the project, and will update the Leon County Cost Feasible Map (Map 28) and the corresponding tables (Tables 13-15) in the Mobility Element.

Text Amendment: This is a request to expand the Urban Services Area to include parcels related to the April Road (LMA202201), Woodville Hwy (LMA202202) and Southwood Plantation (LMA202203) amendments. In the three cases, the proposed map amendment is bisected by and/or directly adjacent to the current Urban Services Area boundary. The proposed amendment would result in approximately 304.7 acres of additional area within the Urban Services Area.

Large Scale Map Amendment: This is a request to change the Future Land Use Map (FLUM) designation from Planned Development (PD) and Rural (R) to Suburban (SUB) on approximately 154.09 acres. The parcels are located along Capital Circle SE and Woodville Highway. The current Planned Development category is intended to identify large land holdings that will be developed for various mixes of land uses, resulting in different types of commercial and residential neighborhoods. The current Rural category is intended to maintain and promote agriculture, silviculture, and natural resource-based activities, to preserve natural systems and ecosystem functions, and to protect the scenic vistas and pastoral development patterns that typify Leon County’s rural areas. Single family residential uses are allowed in the Rural category at a maximum density of one (1) dwelling unit per ten (10) acres. Non-residential uses functionally related to and directly in support of agricultural silvicultural, and other natural resource-based activities may be permitted in the Rural category at a maximum intensity of 2,000 sq. ft. per acre.

The proposed Suburban category is intended to create environment for economic investment or reinvestment through the mutually advantageous placement of employment and shopping opportunities with convenient access to low to medium density residential land uses. This amendment is related to text amendment LTA202201 to adjust the Urban Service Area boundary for the parcel in the county.

Rezoning Application: A rezoning application will be processed concurrently with this amendment. A zoning change from Rural (R) to Single Detached, Attached and Two Family Residential (R-3) will be requested to implement the proposed amendment to the Future Land Use Map.

Small Scale Map Amendment:This is a request to change the Future Land Use Map (FLUM) designation from Government Operational (GO) to High Intensity Urban Activity Center (AC) on approximately 0.33 acres. The parcel is located at the northeast corner of the intersection of Maclay Commerce Drive and Financial Plaza. The current land use category is intended to contain facilities which provide for the operation of and provision of services on property owned or operated by local, state and federal government.

The proposed High Intensity Urban Activity Center land use category is intended to provide for community wide or regional commercial activities located in proximity to multi-family housing and office employment centers, as well as large scale commercial activities to serve retail needs of large portions of the population. Residential development is permitted up to 45 dwelling units per acre.

Rezoning Application: A rezoning application will be processed concurrently with this amendment. A zoning change from Planning Unit Development (PUD) to High Intensity Urban Activity Center (AC) is requested to implement the proposed amendment to the Future Land Use Map.

Large Scale Map Amendment: This is a request to change the Future Land Use Map (FLUM) designation from Rural (R) to Urban Residential 2 (UR-2) on approximately 173.24 acres. The parcels are located along Apalachee Parkway and Old St. Augustine Rd. The current Rural category is intended to maintain and promote agriculture, silviculture, and natural resource-based activities, to preserve natural systems and ecosystem functions, and to protect the scenic vistas and pastoral development patterns that typify Leon County’s rural areas. Single family residential uses are allowed in the Rural category at a maximum density of one (1) dwelling unit per ten (10) acres. Non-residential uses functionally related to and directly in support of agricultural silvicultural, and other natural resource-based activities may be permitted in the Rural category at a maximum intensity of 2,000 sq. ft. per acre.

The proposed Urban Residential 2 category is intended to encourage a range of density (20 dwelling units per acre) housing, thereby promoting infill development, reducing urban sprawl, and maximizing the efficiency of infrastructure. This amendment is related to text amendment LTA202201 to adjust the Urban Service Area boundary.

Rezoning Application: A rezoning application will be processed concurrently with this amendment. A zoning change from Rural (R) and Office Residential (OR-2) to Single Family Detached Residential (R-1) will be requested to implement the proposed amendment to the Future Land Use Map.

The parcel is located between Apalachee Parkway and Old St. Augustine Rd, accessed by Southwood Plantation Rd. to the west of the parcel. The current Rural category is intended to maintain and promote agriculture, silviculture, and natural resource-based activities, to preserve natural systems and ecosystem functions, and to protect the scenic vistas and pastoral development patterns that typify Leon County’s rural areas. Single family residential uses are allowed in the Rural category at a maximum density of one (1) dwelling unit per ten (10) acres. Non-residential uses functionally related to and directly in support of agricultural silvicultural, and other natural resource-based activities may be permitted in the Rural category at a maximum intensity of 2,000 sq. ft. per acre. Comprehensive Plan Amendment Meeting Descriptions

The Comprehensive Plan amendment process includes a series of meetings. Descriptions of these meetings are below.

Public Open House – This open house occurs soon after the application deadline. The primary purpose of this meeting is to inform the public of the applications received and provide an opportunity for preliminary comments.

Local Planning Agency Workshop – The intent of this workshop is to allow Local Planning Agency (LPA), also known as the Planning Commission, and Tallahassee-Leon County Planning Department (TLCPD) staff to have an in-depth discussion of each of the proposed Comprehensive Plan amendments. The workshop is open to the public; however, no public comments are taken.

Local Planning Agency Public Hearing – This is a statutorily required public hearing with the Local Planning Agency. At this hearing, the LPA receives TLCPD staff recommendations on each of the proposed amendments and moves their own recommendations for the Joint City-County Commission. Each interested citizen has up to three minutes to speak.

Joint City-County Commission Workshop – Similar to the LPA Workshop, the intent of this workshop is to allow Joint City-County Commission and TLCPD staff to have an in-depth discussion of each of the proposed Comprehensive Plan amendments. The workshop is open to the public; however, no public comments are taken.

Joint City-County Transmittal Public Hearing – This is a statutorily mandated public hearing with the Joint City-County Commission. The Commissions receive TLCPD and LPA recommendations on each of the proposed amendments and votes on whether to transmit the proposed amendments to State agencies for review. Each interested citizen has up to three minutes to speak.

Joint City-County Adoption Public Hearing – This is a statutorily mandated public hearing with the Joint City-County Commission. The Commissions review comments received from State agencies regarding each of the proposed amendments and votes on whether to adopt the proposed amendments. Each interested citizen has up to three minutes to speak.

Rezoning Public Hearings – For approved map amendments that require rezoning, Public Hearings occur at the respective City Commission or County Commission meetings following the Joint City-County Adoption Public Hearing. Each interested citizen has up to three minutes to speak.
