SUBJECT/TITLE: Introduction of Ordinance No. 09-Z-47: Proposed Addition of the Property to the Local Register of Historic Places and Amendment of the Official Zoning Map to Change the Zoning Classification from the RP-2 (Residential Preservation-2) Zoning District to the RP-2 (Residential Preservation-2) Zoning District with HPO (Historic Preservation Overlay) (PRZ090020).
TARGET ISSUE:

STATEMENT OF ISSUE

The applicant is requesting to add the subject property to the Local Register of Historic Places and to amend the Official Zoning Map to change the zoning classification from the RP-2 (Residential Preservation-2) zoning district to the RP-2 (Residential Preservation-2) zoning district with (HPO) Historic Preservation Overlay. The subject property, constructed in 1933, is a single-family home classified architecturally as a frame vernacular building with Tudor stylistic influences. By oral accounts, 219 Osceola Street was owned in the early 1930’s by Mr. J.R.D. Laster, founder of Greenwood Cemetery. The home is located in a neighborhood (Florida A&M subdivision) that was home to many of Tallahassee’s prominent African American citizens. The proposed ordinance, including a location map, is included as Attachment 1. The applicant is Roselyn Williams.

On August 5, 2009, the Tallahassee-Leon County Architectural Review Board recommended that the above-referenced property (Parcel ID 41-01-42-E-0012) be added to the local register of historic places as reflected in the Order of Recommendation (see Attachment 2). The addition of this property on the local register would make it eligible for certain City grant and loan programs, and would also provide additional protections to the building in the event of redevelopment.

RECOMMENDED ACTION

Option 1: Introduce Ordinance No. 09-Z-47, proposed addition of the property to the Local Register of Historic Places and amendment of the Official Zoning Map to change the zoning classification from the RP-2 (Residential Preservation-2) zoning district to the RP-2 (Residential Preservation-2) zoning district with HPO (Historic Preservation Overlay), and set the first and only public hearing date for November 24, 2009.

FISCAL IMPACT

Structures that have a Historic Preservation Overlay may be exempt from certain land use and permitting fees. Additionally, the Tallahassee Economic and Community Development Department sponsors a grant and low-interest loan program for qualifying HPO properties.

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS
HISTORY/FACTS & ISSUES

Original Zoning: Prior to adoption of the City of Tallahassee Zoning, Site Plan and Subdivision Regulations in 1992, this parcel was zoned RM-1 (Multiple-Family Residential District).

March 1992: The City of Tallahassee implemented “Performance Zoning” and the subject site was zoned RP-2 (Residential Preservation –2).

August 5, 2009: The Architectural Review Board voted unanimously to include the property at 219 Osceola Street in the Tallahassee-Leon County Register of Historic Places (Attachment 3).

November 3, 2009: The Tallahassee-Leon County Planning Commission held a public hearing on this ordinance.

November 24, 2009: The City Commission will hold a public hearing on this ordinance.

Built in 1933, this building is a single family home classified architecturally as a frame vernacular building with Tudor (or English Cottage) stylistic influences. It is located within the Florida A and M subdivision, a neighborhood built for University faculty, and was home to many of Tallahassee’s prominent African-American citizens. The home is in its original location and the design and construction materials have not been significantly altered, with the exception of the rear addition. The building, therefore, remains an example of original workmanship and due to this, the home continues to maintain the feeling of its 1933 construction date.

Public Notification and Response

The application is a Type D review and requires City Commission action. This request has been noticed and advertised in accordance with the provisions of the Tallahassee Land Development Regulations. The Planning Department mailed 96 notices to property owners within 1,000 feet of the subject property. To date, the Planning Department has not received any verbal or written responses to the notice.

Introduce Ordinance No. 09-Z-47, proposed addition of the property to the Local Register of Historic Places and amendment of the Official Zoning Map to change the zoning classification from the RP-2 (Residential Preservation-2) zoning district to the RP-2 (Residential Preservation-2) zoning district with HPO (Historic Preservation Overlay), and set the first and only public hearing date for November 24, 2009.

2. Do not introduce Ordinance No. 09-Z-47, thereby not adding the property to the Local Register of Historic Places and retaining the existing RP-2 (Residential Preservation-2) zoning district, and do not set the public hearing date.

3. Provide staff with alternative direction.
