SUBJECT/TITLE: Introduction of Ordinance No. 09-O-38 Adopting a Comprehensive Plan Amendment for the 2009 Annual Capital Improvements Element Update (Amendment #2009-CIE)

STATEMENT OF ISSUE

City staff has drafted Ordinance 09-O-38 (Attachment 1) to adopt the 2009 Annual Capital Improvements Element Update to the Comprehensive Plan. As of 2008, the City times the City Commission approval of the annual CIE update to coincide with the approval of the City’s annual budget. CIE updates may proceed on a timeframe different from other text amendments and map amendments to the Comprehensive Plan. Ordinance No. 09-O-38 is before the City Commission for introduction and will come back to the City Commission for public hearing and action on September 23, 2009.

RECOMMENDED ACTION

Option 1: Introduce Ordinance No. 09-O-38, and set the public hearing at the City Commission meeting on September 23, 2009, at 6:00 p.m., in the City Commission Chambers, City Hall.

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS

HISTORY/FACTS & ISSUES

Section 163.3177(3)(b), Florida Statutes, requires an annual review of the Capital Improvements Element of the Comprehensive Plan. The CIE must be modified annually to demonstrate that the City is maintaining a financially feasible 5-year schedule of capital improvements. The City must submit an update to the current CIE on or before December 1, 2009. CIE amendments may be adopted outside the regular schedule for Comprehensive Plan amendments, and require only a single public hearing.

City staff has drafted Ordinance 09-O-38 (Attachment 1) to adopt the 2009 Annual Capital Improvements Element Update to the Comprehensive Plan. As of 2008, the City times the City Commission approval of the annual CIE update to coincide with the approval of the City’s annual budget.

Ordinance No. 09-O-38 is before the City Commission for introduction and will come back to the City Commission for public hearing and action on September 23, 2009. Planning staff will present a full report on Exhibit A to be attached to the proposed ordinance at the public hearing on September 23, 2009, at which time the City Commission will act on the proposed Ordinance No. 09-O-38 adopting Amendment #2009-CIE.

OPTIONS

1. Introduce Ordinance No. 09-O-38, and set the public hearing at the City Commission meeting on September 23, 2009, at 6:00 p.m., in the City Commission Chambers, City Hall.

2. Do not approve introduction of Ordinance No. 09-O-38, and provide direction to staff.
