SUBJECT/TITLE: Introduction of Ordinance No. 09-Z-37: Proposed Amendment to the Official Zoning Map from Residential Preservation 2 District to UP-2 Urban Pedestrian 2 District on 1.07 acres fronting on the north side of Orange Avenue between Pasco & Holton Streets and also located on the northwest corner of Orange Avenue and Holton Street.

Introduction of Ordinance No. 09-Z-37; Proposed Amendment to the Official Zoning Map from Residential Preservation 2 District to UP-2 Urban Pedestrian District on 1.07 acres fronting on Orange Avenue between Pasco and Holton Streets and also located on the northwest corner of Orange Avenue and Holton Street. This rezoning implements Large Scale Comprehensive Plan map amendment PCM 090208, which is proposed for adoption on October 13, 2009.
RECOMMENDED ACTION
Option 1: Introduce Ordinance No. 09-Z-37 and set October 13, 2009 at 6 PM in the
Leon County Courthouse as the public hearing date.

HISTORY/FACTS & ISSUES
The subject parcel (shown on Attachment #1, page 3) is the subject of an amendment to the Comprehensive Plan during cycle 2009-2. The City Commission will vote on adopting the amendment on October 13, 2009. Ordinance 09-O-43 is a companion ordinance to this rezoning and adopts the Comprehensive Plan map amendment change to the Suburban category. If these two Ordinances are adopted on October 13, 2009, they will become effective on approximately December 31, 2009.
The original request was for a map amendment change from Residential Preservation (RP) to the Suburban category on one parcel located at the northwest corner of Orange Avenue & Saxon Street. The Local Planning Agency (LPA) recommended the inclusion of the two parcels to the west located at the intersection of Orange Avenue and Holton Streets. The three properties are proposed to be rezoned to UP-2 Urban Pedestrian 2.
The lots are being used for a car wash/detailing and grocery/meat market. Historical records indicate that parcels in the immediate vicinity (including the subject lots) were mapped as RP on the July 1990 future land use map. The construction of the convenience store at the intersection of Orange Avenue and Pasco Street predates this change. It appears that there was a decision to phase out the historical commercial uses along Orange Avenue and to redevelop the lots for low-density residential (0-6 dwelling units per acre). That change in use has not occurred and the subject lots and the parcels to the west fronting on Orange Avenue continue to be nonconforming commercial. The UP-2 zoning as proposed is consistent with the commercial zoning on the east side of Pasco Street.
The approval of the Comprehensive Plan map amendment and rezoning recognizes the historical and present use of Orange Avenue as a corridor with a mix of uses. The change to UP-2 would restore greater development rights to the sites than those allowed by the RP-2 zoning. The existing buildings could be rehabilitated for a variety of commercial and office uses, which is precluded under the current RP-2 zoning.
The subject parcels, including the surrounding residential areas, are located within the boundaries of the Multimodal Transportation District (MMTD). The proposed rezoning will support and further the goal of the MMTD district by promoting a mix of uses, including employment opportunities, within walking distance of nearby residential areas.
The rezoning site is within the Southern Strategy Area. The proposed rezoning would generally support and further Land Use Objective 11.3 (attraction of development to the Southern Strategy Area).
There were 154 notices mailed to property owners within 1,000 of the subject lots. There were no notice responses received.
This rezoning requires City Commission action. The Planning Department and City Treasurer-Clerkâs Office will notice and advertise the application consistent with State Statutes and the Land Development Code.
