SUBJECT/TITLE: Approve Resolution No. 09-R-32 requesting an easement from the Florida Department of Environmental Protection
TARGET ISSUE:

STATEMENT OF ISSUE

The City of Tallahassee has requested a utility easement from the State of Florida for the purpose of operating and maintaining a pump station and force main to provide sewer service to apartments and state offices at the new Capital Circle Office Complex site on Capital Circle southeast at Southwood. The City of Tallahassee has requested the easement from the Department of Environmental Protection, Division of State Lands, on behalf of the State of Florida, which requires the attached resolution.

RECOMMENDED ACTION

Option 1. Approve Resolution 09-R-32

Option 2. Reject Approval of Resolution 09-R-32 and provide alternate direction to staff.

FISCAL IMPACT

None. The City Attorney’s office and the Office of Budget and Policy have reviewed this agenda item and concur with the recommended action.

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS

HISTORY/FACTS & ISSUES

The Water Utility has requested that Property Management acquire a utility easement to operate and maintain a pump station and force main constructed by the State Department of Management Services. This will provide sewer service to apartments and state offices in the Southwood area at the new Capital Circle Office Complex site on Capital Circle Southeast.

The City is requesting the easement from the State’s Department of Environmental Protection, Division of State Lands, on behalf of the State of Florida, which requires the attached resolution. There is no cost for the easement.

OPTIONS

1. Approve Resolution No. 09-R-32

Staff recommends this option because it will allow DEP to grant an easement that will provide sewer service to the Capital Circle Office Complex.

2. Do not approve Resolution No. 09-R-32 and provide alternate direction to staff.

Staff does not recommend this option because sewer service cannot be provided without this easement.
