SUBJECT/TITLE: Introduction of Ordinance No. 09-O-32; Approving Inclusion of the Incorporated Area of the City Within the Leon County Emergency Medical Services Municipal Service Taxing Unit
TARGET ISSUE:

STATEMENT OF ISSUE

On June 25, 2003, the City Commission of the City of Tallahassee passed Ordinance No. 03-O-36AA consenting to inclusion of all the incorporated area of the City of Tallahassee in the Leon County Emergency Medical Services Municipal Services Taxing Unit until September 30, 2004. On January 18, 2004, the Commission passed Ordinance No. 04-O-21 extending such consent until September 30, 2009.

The City and Leon County entered into an Interlocal Agreement Regarding the Provision of Fire and Emergency Medical Services dated April 16, 2009. That agreement, which becomes effective on October 1, 2009, provides that the City, prior to such effective date, will revise or amend Ordinance No. 03-O-36AA, as previously amended, to extend consent for inclusion of the incorporated area of the City in the EMS MSTU until the end of the “Current Term” of that agreement. Ordinance No. 09-O-32 provides that consent.

RECOMMENDED ACTION

Approve Option 1: Introduce Ordinance No. 09-O-32 and set a public hearing on the ordinance for August 26, 2009.

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS
HISTORY/FACTS & ISSUES

The Board of County Commissioners of Leon County, Florida, established by ordinance the Leon County Emergency Medical Services Municipal Services Taxing Unit (“EMS MSTU”) for the purpose of providing certain emergency medical services (as identified in such ordinance) to persons in the City and in the County. On June 25, 2003, the City Commission of the City of Tallahassee passed Ordinance No. 03-O-36AA consenting to inclusion of all the incorporated area of the City of Tallahassee in the EMS MSTU for a period of one fiscal year. On January 18, 2004, the Commission passed Ordinance No. 04-O-21 extending such consent until September 30, 2009.

The City and Leon County entered into an Interlocal Agreement Regarding the Provision of Fire and Emergency Medical Services dated April 16, 2009. That agreement, which becomes effective on October 1, 2009, provides that the City, prior to such effective date, will revise or amend Ordinance No. 03-O-36AA, as previously amended, to extend consent for inclusion of the incorporated area of the incorporated area of the City in the EMS MSTU until the end of the “Current Term” of that agreement. “Current Term” is defined in the agreement to mean the five (5) year term of that agreement in effect at a particular point in time.

Ordinance No. 09-O-32 provides the City’s consent, effective October 1, 2009, to continued inclusion of the incorporated area of the City in the EMS MSTU in accordance with requirements of the Interlocal Agreement.

OPTIONS

Option 1: Introduce Ordinance No. 09-O-32 and set a public hearing on the ordinance for August 26, 2009.

Option 2: Do not introduce Ordinance No. 09-O-32.
