SUBJECT/TITLE: Approve Resolution No. 09-R-11 requesting an easement from the Florida Department of Environmental Protection

STATEMENT OF ISSUE
The Electric Utility-Power Engineering Division has requested that Property Management acquire an electric utility easement from the State of Florida. The easement is necessary to widen an existing easement to service existing and future lines. The City of Tallahassee has requested the electric utility easement from the Florida Department of Environmental Protection (DEP), Division of State Lands on behalf of the State of Florida.
RECOMMENDED ACTION

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS
HISTORY/FACTS & ISSUES
On February 13, 2009, the Florida Department of Environmental Protection (DEP), Division of State Lands, contacted the City’s Electric Utility regarding existing electric lines not lying completely within a ten (10’) foot wide easement on the property they were purchasing off Natural Bridge Road. DEP offered to widen the existing easement to accommodate existing and future lines. The State requires the City to adopt a resolution authorizing the acquisition of this easement.
OPTIONS
Option 1. Approve Resolution No. 09-R-11
Staff recommends this option because it will allow DEP to widen the existing easement to accommodate existing and future lines.
Option 2. Do not approve Resolution No. 09-R-11
Staff does not recommend this option because the project cannot be completed without this easement.
