STATEMENT OF ISSUE
The applicant is requesting an amendment to the Official Zoning Map to change the zoning classification from the M-1 (Light Industrial) to the CP (Commercial Parkway) Zoning District. The property is located at 2500 Springhill Road and totals 0.73 acres. The proposed ordinance, including a location map, is included as Attachment 1. The applicant for this project is Mr. Seongjong Hong.
RECOMMENDED ACTION
1. Introduce Ordinance No. 09-Z-26, a Proposed Amendment to the Official Zoning Map to Change the Zoning Classification from the M-1 (Light Industrial) to the CP (Commercial Parkway) Zoning District, and schedule the First and Only Public Hearing on August 26, 2009.

History
Zoning History:
§ Prior to the adoption of the City of Tallahassee Zoning, Site Plan and Subdivision Regulations in 1992, the parcel was zoned M-2 General Industrial.
§ In 1992, the City of Tallahassee rezoned the subject property Mixed Use B pursuant to the adoption of the revised Tallahassee-Leon County Comprehensive Plan.
§ During the 1997 Site Specific Zoning initiative the site was rezoned to M-1 Light Industrial.
June 2, 2009: The Planning Commission will hold a public hearing on Ordinance No. 09-Z-26.
August 26, 2009: The City Commission will hold a public hearing on Ordinance No. 09-Z-26.
Summary of Application
The applicant is seeking a rezoning from the M-1 (Light Industrial) Zoning District to the CP (Commercial Parkway) Zoning District for one parcel totaling 0.73 acres located at 2500 Springhill Road. The existing M-1 district allows similar land uses to those allowed in CP Commercial Parkway; however, the latter introduces a wide array of retail uses. Adjacent parcels are a mixture of M-1, C-2, and Open Space (OS), which is intended for future St. Marks and GFA Trailheads. There are no CP districts in the surrounding area, and applying CP in an area where none exists constitutes a ‘spot zoning.’ Additionally, the CP district is not to be applied within the Central Core.
Public Notification and Response
This request has been noticed and advertised in accordance with the provisions of the Tallahassee Land Development Code. The Planning Department mailed 80 notices to property owners in the effected areas. To date, staff has received 1 phone call, but no emails or written responses.
