SUBJECT/TITLE: Approve Resolution No. 09-R-13, requesting an easement from the Florida Department of Environmental Protection
TARGET ISSUE: Utility Services

STATEMENT OF ISSUE

The Electric Utility-Power Engineering Division has requested that Property Management acquire an electric utility easement. The easement is necessary to construct new electric distribution facilities, including a transformer, that will provide power to the First District Court of Appeals, which is currently under construction on Esplanade Way and Drayton Drive. The City of Tallahassee has requested an electric utility easement from the Florida Department of Environmental Protection (DEP), Division of State Lands on behalf of the State of Florida.

RECOMMENDED ACTION

Option 1. Approve Resolution 09-R-13

Option 2. Do not approve Resolution 09-R-13

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS
HISTORY/FACTS & ISSUES

The City of Tallahassee has requested an electric utility easement from the Florida Department of Environmental Protection (DEP), Division of State Lands on behalf of the Board of Trustees of the Internal Improvement Trust Fund (TIITF) of the State of Florida. The easement is needed for constructing new electric distribution facilities, including a transformer and other associated equipment, which will provide service to the First District Court of Appeals in Southwood, currently under construction on Esplanade Way and Dayton Drive. The Florida Department of Environmental Protection requires that the City Commission adopt a resolution authorizing acquisition of this utility easement pertaining to the parcel described in Attachment 2.

OPTIONS

1. Approve Resolution No. 09-R-13

Staff recommends this option because it will allow DEP to grant an easement that will provide electric service to the building.

2. Do not approve Resolution No. 09-R-13

Staff does not recommend this option because the project cannot be completed without this easement.
