STATEMENT OF ISSUE
The application is for a change to the Official Zoning Map from the CPA (Critical Planning Area) to the Canopy PUD (Planned Unit Development) zoning district (see Attachment 1, Ordinance Number 07-Z-43AA). The proposed project is the development of 162,927 square feet of commercial/office space and 1,258 residential dwelling units. In addition, if eligible for all density bonuses provided by the City’s Inclusionary Housing Ordinance, a 25% density increase from 1,258 to 1,572 units could result, and would contain a minimum of 126 inclusionary units if owner-occupied, a maximum of 189 if rental units, or any combination thereof within that range. The subject project is located on 508 acres on the south side of Centerville Road, in the east half section of 15 and the west half section of 14 of the Welaunee Plantation (the area constitutes the “Toe” of Welaunee, see Attachment 2, location map). The applicant and owner is CNL Tallahassee I, LLC.
RECOMMENDED ACTION
Option 1: Continue this item to the August 26, 2009 City Commission Meeting.
(The applicant has requested the continuance to allow additional time to resolve outstanding issues.)
FISCAL IMPACT
The proposed rezoning would affect permitted densities, thereby potentially altering ad valorem taxes.

History
Original Zoning: Prior to adoption of the City of Tallahassee Zoning, Site Plan and Subdivision Regulations in 1992, the parcel was zoned A-2. The A-2 district allowed normal agricultural activities, outdoor recreational activities, certain resource development activities and other uses compatible with agricultural uses.
1992: The City of Tallahassee rezoned the subject property from A-2 to MU-B pursuant to the adoption of the revised Tallahassee-Leon County Comprehensive Plan in 1990.
2002: Critical Area Plan for Welaunee (Goal 13) adopted in the Comprehensive Plan.
May 21, 2007: Pre-Application meeting held.
June 22, 2007: Date of initial application.
August 29, 2007: Implementing Ordinance No. 07-Z-43 was introduced to the City Commission and the public hearing was set for October 24, 2007.
September 24, 2007: The City of Tallahassee Development Review Committee (DRC) held its first meeting on the proposed PUD Concept Plan application. It was subsequently continued numerous times.
October 24, 2007: The City Commission voted to continue the public hearing on this item to the January 23, 2008 City Commission Meeting.
January 23, 2008: The City Commission voted to continue the public hearing on this item to the April 23, 2008 City Commission Meeting.
April 23, 2008: The City Commission voted to continue the public hearing on this item to the June 25, 2008 City Commission Meeting.
May 12, 2008: The DRC voted 3-1 to approve the application with conditions as discussed herein below.
June 3, 2008: The Tallahassee/Leon County Planning Commission held a public hearing on this item and continued the public hearing to the June 17, 2008 Planning Commission Meeting.
June 17, 2008: The Tallahassee/Leon County Planning Commission voted to continue the public hearing on this item to August 5, 2008.
June 25, 2008: The City Commission voted to continue the public hearing on this item to the August 20, 2008 City Commission Meeting.
August 5, 2008: The Tallahassee/Leon County Planning Commission voted to continue the public hearing on this item to October 7, 2008.
August 20, 2008: The City Commission voted to continue the public hearing on this item to the October 22, 2008 City Commission Meeting.
October 7, 2008: The Tallahassee/Leon County Planning Commission voted to continue the public hearing on this item to January 6, 2009.
October 22, 2008: The City Commission voted to continue the public hearing on this item to the February 25, 2009 City Commission Meeting.
January 6, 2009: The Tallahassee/Leon County Planning Commission voted to continue the public hearing on this item to August 4, 2009.
February 25, 2009: If the continuance is approved, this application will be scheduled for the first and only public hearing before the City Commission on August 26, 2009.

Summary of Application
The applicant is proposing a multi-use development containing up to 1,572 dwelling units of different types (with additional density bonuses, if applicable) and up to 162,927 gross square feet of nonresidential land uses. The application is a Type D review and requires City Commission action. This ordinance requires one public hearing before the City Commission. This request has and will continue to be noticed and advertised in accordance with the provisions of the Tallahassee Land Development Code.
