SUBJECT/TITLE: Notice of Proposed Change (NOPC) to the Airport Development of Regional Impact (DRI)
TARGET ISSUE:

STATEMENT OF ISSUE
On December 23, 2008, the City of Tallahassee submitted a Notification of Proposed Change (NOPC), including a revised Development Order (DO) to the previously approved Airport Development of Regional Impact (DRI) to the Florida Department of Community Affairs (DCA), and the Apalachee Regional Planning Council (ARPC). The NOPC was submitted in accordance with Section 380.06(19), Florida Statutes. The Airport DRI was originally approved April 18, 1974 and last amended on January 24, 2001. The proposed amendment represents the seventh amendment to the DO.

RECOMMENDED ACTION
Option #1: Determine the NOPC to the Airport DRI is not a “substantial deviation” and approve the City’s Seventh Amendment to the Amended Development Order found in Attachment #1.

SUPPLEMENTAL MATERIAL/ISSUE ANALYSIS
HISTORY/FACTS & ISSUES

The NOPC booklet (Attachment #2) describes the specific change to the Airport DRI that is proposed at this point in time. The change can be summarized as follows:

1. Add 3,300 sq. ft. of General Aviation Terminal Office
2. Add 23,300 sq. ft. of Fixed Base Operator
3. Add 100 room General Aviation Hotel
4. Add 6,800 sq. ft. of Maintenance Buildings
5. Reduce 15,612 sq. ft. of Limited FBO/Tallahassee Aerospace Centre
6. Reduce 85,000 sq. ft. of Aviation Related Industry

The Airport DRI NOPC was distributed to the following City Departments for their review: City Attorney’s Office, Public Works, Utility Services (potable water, sanitary sewer, electric, gas), Planning, and Growth Management. All comments received from City staff are summarized below:

GROWTH MANAGEMENT:
Growth Management staff reviewed the application in accordance with the substantial deviation criteria outlined in Section 280.06(19), Florida Statutes and found that the amendments do not trigger a finding of substantial deviation. The amendment causes no concurrency mitigation as a result of the balancing development levels.

PLANNING DEPARTMENT:
The proposed change is in compliance with the applicable policies of the Tallahassee-Leon County Comprehensive Plan.

STATE OF FLORIDA STAFF REVIEW AND COMMENTS:
The Apalachee Regional Planning Council (ARPC) distributed the Airport DRI NOPC to the following state agencies: Florida Department of Community Affairs; Florida Department of Environmental Protection; Florida Department of Transportation; Florida Fish & Wildlife Conservation Commission; and the Northwest Florida Water Management District. The consultant for the Airport responded to the questions raised and the agencies reported back to the ARPC. Based on the responses received from the agencies, the ARPC sent the City a letter (see attachment 3) that states the NOPC changes do not constitute a substantial deviation and this completes their review of the NOPC.

TALLAHASSEE-LEON COUNTY PLANNING COMMISSION REVIEW AND RECOMMENDATION:
On February 11, 2009, the Planning Commission met and voted unanimously to recommend approval of the Seventh Amendment to the Amended Development Order and that the NOPC is consistent with the Comprehensive Plan.

CHARITABLE CONTRIBUTIONS
N/A

OPTIONS

1. Determine the NOPC to the Airport DRI is not a “substantial deviation” and approve the City’s Seventh Amendment to the Amended Development Order found in Attachment #1.

Pros: Proposal allows for a better use of property and increases the economic value and developments of other uses.

Cons: May be deemed excessive development.

2. Determine the NOPC to the Airport DRI is a “substantial deviation” and do not approve the City’s Seventh Amendment to the Amended Development Order found in Attachment #1.

Pros: Will require a more extensive review of the proposed development.

Cons: With no traffic of other impacts to concurrency a more detailed review will only result in time delays to the development proposal.

3. Provide alternative direction.
