SUBJECT/TITLE: Approval of Resolution No. 09-R-04; Authorization of Road Closures for Special Events
TARGET ISSUE:

STATEMENT OF ISSUE
Florida Statute 337.406 requires formal local government approval and permitting before a state road can be closed for parades and other special events. Specifically, it provides: "Before a road on the state highway system may be temporarily closed for a special event, the local governmental entity which permits the special event to take place must determine that the temporary closure of the road is necessary and must obtain the prior written approval for the temporary road closure from the department." The Legal Department of the DOT interprets this language to actually require a resolution by the governing body.

HISTORY/FACTS & ISSUES
The City of Tallahassee is involved in closing state highways (particularly Monroe Street) on several different occasions throughout the year. A resolution is attached along with a list of the events. The resolution determines the necessity of closing streets for the events and authorizes the appropriate administrative officials to apply to DOT for the appropriate permits.
